Established in 2004, Cliantha is a leading global Clinical Research Organization (CRO) headquartered in Ahmedabad – India with facilities and operations in Baroda (India), Noida (India), Florida (USA), Toronto (Canada) and Mississauga (Canada). We value the commitment we provide to our customers and respect the privacy of all individuals whose Personal Information may be processed by Cliantha in the performance of our services and our business operations.

This Policy applies to all Personal Information of Individuals, either in electronic or paper format, received by Cliantha.

We may change this Policy from time to time by updating this page without notice to ensure that an appropriate level of protection for Personal Information is maintained. You acknowledge and agree that it is your responsibility to review the Terms of Privacy Policy periodically to familiarize yourself with any modifications. Your continued use of this website after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

DEFINITIONS: For purposes of this Policy, the following definitions shall apply:

“Individual” means any natural person.

“Cliantha” means any entity that directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with Cliantha Research Limited. For purposes of this definition, “control” means the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of such entity, whether through the ownership of voting securities, by contract or otherwise.

“Personal Data” or “Personal Information” means any information relating to an Individual.

“Sensitive Personal Data” means Personal Data that require a higher level of protection under applicable Data Protection laws, i.e., Personal Data revealing racial or ethnic origin; government-issued identification numbers; trade union membership; and the processing of genetic or biometric data to identify a natural person uniquely, data concerning health; or data concerning a natural person’s sex life and sexual orientation; and data relating to criminal convictions and offenses.

“Applicable Data Protection laws” means Laws (either national laws and/or local regulations) in force that apply to the Processing of Personal Data by Cliantha.


What we collect

We may collect from you Personal Data which is necessary to render services like person identification, contact information including email address, demographic information such as postcode, preferences and interests, mailing address, or telephone number that can be used to identify you. We will process your Personal Data as described in this Privacy Policy. However, we reserve the right to conduct additional processing to the extent permitted or required by law, or in support of any legal or regulatory requirement. The next sections explain how and when we collect Personal Data from you.


Categories of Personal Data Collected

Employees & potential employees
Personal Data such as name, images, email, address, date of birth, sex, gender, race and ethnicity, family members, health records, marital status, emergency contact, citizenship or legal status, telephone, qualification, education, professional licenses and certificates, work experience, position, professional membership, professional training, account details, etc. for employment purposes.

Client’s/Vendor’s employees, representatives, agents and associates
Personal Data such as name, company name, phone numbers, work email for business communication purposes.

Websites visitors
Personal Data such as first and last name, company name, IP address, email address for potential advertisement, marketing purpose and website improvements.

Trial Participants
Cliantha collects data of clinical trial participants for conduct of clinical studies. To maintain confidentiality of the data, it is accessible only to designated employees and will be retained on the website for six (6) months.

Sensitive Personal Information
Where required by law, Cliantha may ask for data subject’s explicit consent to collect information considered to be sensitive Personal Information (such as information about ethnicity or health information).

Cliantha will collect sensitive Personal Information through its websites. We obtain personally identifying information about you only if you voluntarily choose to provide such information via legitimate correspondence.

IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). What we do with the information we gather

Most of our services do not require any form of registration, allowing you to visit our site without telling us who you are. However, some services may require you to provide us with Personal Information. Controlling your Personal Information

We may disclose your Personal Information to other Cliantha affiliates worldwide that agree to treat it in accordance with this Privacy Policy. Personal Information may also be transferred to third parties who act on our behalf, for further processing in accordance with the purpose(s) for which the data were originally collected or may otherwise be lawfully processed, such as service delivery, evaluating the usefulness of this website, marketing, data management or technical support. These third parties have contracted with us to only use Personal Information for the agreed upon purpose and not to sell your Personal Information to third parties and not to disclose it to third parties except as may be required by law, as permitted by us or as stated in this Privacy Policy.


Information Retention

The information we collect will be archived or stored by us for a period of six (6) months according to our standard operating procedures and will be retained for the purposes for which it was collected – to provide services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws.


Information Integrity and Purpose Limitation

Cliantha endeavors to use Personal Information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the Individual. Cliantha will take reasonable steps designed to ensure that only Personal Information that is relevant to its intended use, accurate, complete, current, and otherwise reliable in relation to the purposes for which the information was obtained is used by Cliantha for as long as Cliantha retains possession of such information. Cliantha’s Personnel have a responsibility to assist Cliantha in maintaining records of accurate, complete and current Personal Information. When acting as a CRO or in other situations where Cliantha acts on behalf of another entity, Cliantha endeavors only to process Personal Information that is relevant to the services it provides, and only for purposes compatible with those for which the Personal Information was collected; wherever possible, such Personal Information is non-identified. Where Cliantha processes Personal Information as a CRO or otherwise acts under the direction of its clients, Cliantha works with such clients so that the clients can provide a way for individuals to correct or update their Personal Information to the extent required by law.


Right of Access, Correction and Objection

Whenever we process Personal Information, we take reasonable steps to ensure that your Personal Information is kept accurate and up-to date for the purposes for which it was collected. We will provide you with the ability to object to the processing of your Personal Information if such processing is not reasonably required for a legitimate business purpose as described in this Policy or our compliance with law. In the case of electronic direct marketing, we will provide you with a method to opt out of receiving further marketing materials or with a method to opt in if required by law. If you contact us, please note the name of the website where you provided the information, as well as the specific information you would like us to correct, update or delete plus a proper identification of you. Requests to delete personal data will be subject to any applicable legal and ethical reporting or document filing or retention obligations imposed on us.

If you are an EU resident, you may have additional rights available to you with regards to your Personal Information, including the right to file a complaint with your local data protection authority, the right to object to your data being processed, and certain rights related to our use of any automated-decision making processes (to the extent applicable). Cliantha will, on request, provide Individual with confirmation regarding whether Cliantha is processing Personal Information about them, consistent with applicable law. In addition, upon request of an Individual, Cliantha may take reasonable steps to comply with an Individual rights request, except where the burden or expense of providing access would be disproportionate to the risks to that Individual’s privacy, where the rights of persons other than the individual would be violated or where doing so is otherwise inconsistent with applicable law. Unless prohibited by applicable law, Cliantha reserves the right to charge a reasonable fee to cover costs for providing copies of Personal Information requested by Individuals. Cliantha, when acting as a CRO, has no direct relationship with medical research subjects participating in a clinical trial and any such individuals who seek access, or who seek to correct, amend, or delete their inaccurate Personal Information should direct his or her query to the relevant study sponsor or investigator which has transferred such Personal Information to Cliantha for processing.


Personal Information and Children

Most of the services available on this site are intended for persons 19 Years of age and older. Any individual who views and requests any information about any matter on the website must be 18 or over. We will not knowingly collect, use or disclose Personal Information from a minor under the age of 18, without obtaining prior consent from a person with parental responsibility (e.g., a parent or guardian) through direct off-line contact if available. We will provide the parent with (i) notice of the specific types of personal data being collected from the minor, and (ii) the opportunity to object to any further collection, use, or storage of such information subject to availability of the contacts of parent. We abide by laws designed to protect children.
